1. Eligibility

You must be at least 18 years old, and old enough to enter into a binding agreement where you live, to create an account or use the Service. If the age of majority where you live is higher than 18, you must be at least that age.

You are responsible for providing accurate information about your age and your other account information.

Kratex is currently offered only to people located in the Asia-Pacific region. We do not offer the Service in other regions, and it is not intended for use by people located outside the Asia-Pacific region. We may restrict or end access from outside the Asia-Pacific region, and where the Service is available may change over time.

If we learn that an account belongs to someone under the age required by this section, we may suspend or close it and delete the associated information, subject to applicable law.

Kratex may introduce additional age or eligibility requirements for particular features or future versions of the Service.

2. Description of the Service

Kratex provides fitness and wellness tools that may include:

• workout planning and tracking;
• exercise demonstrations and instructions;
• progress and performance tracking, including activity streaks and calendars;
• running and cardio tracking;
• the Kratex app for Apple Watch, for tracking strength workouts and other activities (“free workouts”) from your wrist, with heart rate and calorie readings;
• fitness profiles and body measurements;
• nutrition and meal tracking;
• food and meal photo analysis;
• calorie and macronutrient estimates;
• AI-powered fitness coaching and recommendations;
• activity and health-platform integrations;
• workout and run summary images that you can share through other apps; and
• other related fitness and wellness features.

Features may vary depending on your device, operating system, permissions, subscription status, geographic location, and app version.

3. Not Medical Advice

Kratex does not provide medical diagnosis, medical treatment, emergency services, or professional healthcare.

Content, recommendations, AI-generated responses, calorie estimates, nutritional information, exercise instructions, fitness calculations, and other information provided through Kratex are intended for general informational and fitness purposes only.

Heart rate and calorie readings from the Kratex Apple Watch app are general wellness estimates. They are not intended to diagnose, monitor, or treat any medical condition, and Kratex does not alert you to abnormal readings. Do not rely on them for medical decisions.

Kratex is not a substitute for a physician, qualified healthcare professional, registered dietitian, physical therapist, mental-health professional, or emergency medical service.

You should consult an appropriately qualified professional before beginning or changing an exercise, nutrition, weight-management, or other health program where appropriate.

If you experience concerning symptoms during exercise or other physical activity, stop the activity and seek appropriate medical attention. In an emergency, contact your local emergency services.

4. Exercise and Physical Activity Risks

Physical activity involves inherent risks, including strains, sprains, falls, injuries, overexertion, dehydration, cardiovascular events, and other complications. Some activities you can track with Kratex, such as ball sports, boxing, martial arts, and high-intensity interval training, carry additional risks of contact, impact, and injury.

You are responsible for determining whether an activity is appropriate for your individual circumstances, and for using suitable equipment, supervision, and a safe environment.

Kratex does not guarantee that a particular exercise, workout, training program, recommendation, progression, or activity is suitable for you.

5. Nutrition Information

Kratex may provide nutritional information including calories, protein, carbohydrates, fats, serving sizes, and other estimates.

Information may originate from databases, user input, food photographs, automated analysis, third-party information, or other sources and may be inaccurate or incomplete.

Actual nutritional values can vary materially based on brands, ingredients, preparation methods, recipes, serving sizes, and other factors.

Kratex does not provide medical nutrition therapy.

If you have a medical condition, allergy, dietary restriction, eating disorder, or other health concern, consult an appropriately qualified professional before relying on nutritional recommendations.

6. AI-Powered Features

Kratex may provide AI-powered features including food and meal photo analysis, nutrition estimates, workout recommendations, fitness coaching, automated summaries, and personalization. The AI coach is an AI system, not a person.

Depending on the feature, information you provide or information associated with your Kratex account (for example a food photo, your training history, or a message you type to the coach) may be sent to and processed by third-party AI service providers acting on Kratex’s behalf, only after you allow it in the app. Our Privacy Policy describes what is sent and who receives it.

AI-generated information may be incomplete, inaccurate, outdated, or unsuitable for your circumstances. AI features are not medical diagnosis, treatment, or professional healthcare advice.

You remain responsible for reviewing AI-generated information and deciding whether and how to act on it. Kratex does not guarantee that AI-generated recommendations will produce a particular fitness, health, weight, performance, or nutritional outcome.

Please do not include information in AI messages that you do not want processed by the AI provider.

7. User Accounts

You agree to provide accurate and reasonably current information when creating and maintaining your account.

Some features, such as AI features, buying a subscription, and email sign-in codes, require you to confirm your email address with a one-time code we email you.

You are responsible for maintaining the confidentiality of your credentials and for activity occurring through your account, including on devices paired with it such as your Apple Watch, except where applicable law provides otherwise.

You must notify Kratex if you believe your account has been accessed without authorization.

You must not create an account using another person’s identity or information without authorization.

8. User Content

Kratex may allow you to submit or create content including workout records, exercise history, nutrition records, food photographs, run photographs, profile photographs, fitness profile information, body measurements, notes, and feedback.

You retain ownership of content that you own.

By submitting content to Kratex, you grant Kratex a limited, non-exclusive, worldwide license to host, store, reproduce, process, display, and transmit that content only as reasonably necessary to operate, maintain, secure, and provide the Service to you, including sending it to service providers as described in our Privacy Policy. This license does not transfer ownership of your content to Kratex.

We do not use your photographs, coaching messages, or fitness data to train our own AI models.

You are responsible for ensuring that you have the necessary rights and permissions to submit content.

9. Sharing Your Content Outside Kratex

Kratex may let you create images or summaries of your workouts and runs and share them through other apps on your device.

Once you share content outside Kratex, it is governed by the service you share it with, and it may be seen, copied, or redistributed by others. Kratex cannot control or remove it there.

You should not share personal, health, location, photographic, or other information if you do not want other people to see it. Route and location information in a shared image may reveal where you live, work, or exercise.

If we introduce features that let you share content with other Kratex users, we will update these Terms and our Privacy Policy, and explain the audience and visibility controls, before those features take effect.

10. Photos and Camera Features

Kratex may allow you to capture or upload food photographs, run photographs, profile photographs, and other images.

You are responsible for having the necessary rights and permissions to upload photographs.

Do not upload photographs containing another person’s private or sensitive information without appropriate authorization.

11. Health and Fitness Data

Kratex may allow you to record or provide information relating to fitness, physical activity, nutrition, body measurements, workouts, running, and other wellness activities.

Some information processed by Kratex may constitute sensitive personal information under applicable privacy laws.

Our collection, use, storage, disclosure, retention, and protection of personal information are described in our Privacy Policy.

Where supported, Kratex may request permission to read from, and write workouts to, Apple Health, Health Connect, or other health and fitness platforms. With your permission, the Kratex app for Apple Watch measures heart rate and calories during workouts you track on the Watch and saves those workouts, with their measurements, to Apple Health. You control whether to grant these permissions through your device or platform settings, subject to the functionality of the Service.

Workouts saved to Apple Health or Health Connect are kept by those platforms. Deleting a workout or your account in Kratex does not remove copies already saved there.

12. Third-Party Services

Kratex may integrate with third-party services, APIs, databases, hosting providers, AI providers, analytics providers, security providers, payment providers, mapping services, authentication providers, health platforms, and other technologies.

Third-party services may have their own terms and privacy policies.

Kratex is not responsible for the independent practices, availability, accuracy, security, or performance of third-party services except to the extent required by applicable law.

Where third parties process personal information on Kratex’s behalf, Kratex will take reasonable steps to require appropriate privacy and security protections consistent with applicable law and our Privacy Policy.

13. Subscriptions and Paid Features

Kratex may offer free and paid features, subscriptions, trials, or usage limits.

Before you purchase, we show the price, the billing period, whether the subscription renews automatically, any trial terms, and how to cancel. Purchases made through the Apple App Store, Google Play, or another marketplace are also governed by that marketplace’s terms.

Where a subscription automatically renews, it continues to renew until you cancel it through the applicable marketplace or payment mechanism, and cancellation must be made before the renewal date to avoid the next charge.

Deleting the Kratex app or your Kratex account does not cancel an active subscription. You must cancel it in your marketplace account settings.

You must not manipulate usage limits or subscription entitlements.

14. Refunds

Payments made through the Apple App Store, Google Play, or another third-party marketplace are subject to that provider’s refund procedures and applicable law.

Where required by applicable law, you may have additional refund or consumer rights.

For purchases made through Apple, refund requests are handled through Apple’s refund process.

15. Acceptable Use

You must not:

• use Kratex for unlawful purposes;
• attempt unauthorized access to the Service or another person’s account;
• circumvent security or usage restrictions;
• reverse engineer the Service except where legally permitted;
• interfere with the operation of the Service;
• abuse automated systems or APIs;
• manipulate usage limits or subscription entitlements;
• upload malicious code;
• impersonate another person;
• infringe intellectual property, privacy, or other rights;
• exploit AI features for unlawful purposes;
• harass, threaten, or abuse any person;
• upload unlawful or harmful content; or
• otherwise violate applicable law.

16. Intellectual Property

The Service and its contents, including software, designs, interfaces, logos, trademarks, graphics, text, illustrations, exercise content, audiovisual materials, and other materials provided by Kratex, are owned by or licensed to Kratex and are protected by applicable intellectual property laws.

Except as expressly permitted by Kratex or applicable law, you may not reproduce, distribute, modify, publicly display, commercially exploit, or create derivative works from Kratex’s proprietary materials.

Apple, Apple Watch, Apple Health, and HealthKit are trademarks of Apple Inc. Kratex is not affiliated with or endorsed by Apple.

17. Copyright and Rights Complaints

If you believe content available through Kratex infringes your copyright or other legal rights, contact us at support@kratex.fit with: a description of the material and where it appears; your contact details; the right you believe is infringed; and a statement that you are the rights holder or authorized to act for them.

Kratex may remove or restrict content where appropriate.

18. Availability and Changes to the Service

We aim to keep Kratex available and reliable but do not guarantee uninterrupted availability.

The Service may be unavailable or modified because of maintenance, updates, technical problems, network failures, device limitations, third-party outages, security incidents, or circumstances beyond our reasonable control.

The Kratex app for Apple Watch needs a compatible Apple Watch paired with an iPhone that has the Kratex app installed, and supported versions of watchOS and iOS. Some Watch features need Apple Health access, and keeping a workout in step between the Watch and iPhone depends on their connection.

Kratex may add, modify, suspend, or discontinue features subject to applicable law and any rights you may have under applicable subscription or consumer-protection requirements.

19. Accuracy of Information

We make reasonable efforts to provide useful information but do not guarantee that information is complete, accurate, current, error-free, or suitable for your circumstances.

This includes exercise information, nutritional information, calorie estimates, AI-generated information, fitness calculations, activity measurements, route information, and automated data.

Heart rate and calorie readings come from Apple Watch sensors and Apple Health. Their accuracy depends on the device, how it is worn, your movement, and other factors, and readings may be missing or wrong for some activities.

20. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis.

Kratex disclaims warranties to the extent permitted by law, including warranties that the Service will be uninterrupted, error-free, secure, accurate, or suitable for a particular purpose.

Nothing in these Terms excludes or limits rights, warranties, or remedies that cannot legally be excluded or limited.

21. Limitation of Liability

To the maximum extent permitted by applicable law, Kratex and its owners, officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Service.

This includes damages related to reliance on information, inaccurate AI results, nutritional estimates, heart rate or calorie readings, workout recommendations, service interruptions, loss of data, or third-party services.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

22. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Kratex and its owners, officers, employees, contractors, affiliates, and service providers from claims, liabilities, damages, losses, and expenses arising from your material violation of these Terms, misuse of the Service, violation of another person’s rights, violation of applicable law, or content you submit.

This provision does not apply to the extent prohibited by applicable law.

23. Termination

You may stop using Kratex at any time, and you can delete your account in the app.

Kratex may suspend or terminate access where reasonably necessary because of a material violation of these Terms, security or legal risks, abusive or fraudulent activity, a requirement of law, or discontinuation of the applicable Service.

Where appropriate and practicable, Kratex may provide notice before termination.

Termination does not automatically eliminate obligations that by their nature should continue after termination.

24. Changes to These Terms

We may update these Terms from time to time.

For material changes, we will provide notice through the Service, website, email, or another reasonable method before they take effect. The updated Terms will include a revised “Last updated” date.

Where required by applicable law, we will obtain any required consent or provide additional notice. If you do not agree to updated Terms, you should stop using the Service and may delete your account.

25. Privacy

Your use of Kratex is also governed by our Privacy Policy, which explains how we collect, use, store, disclose, retain, and protect personal information, and describes your rights and available privacy choices.

26. Governing Law

These Terms are governed by the laws of the Republic of the Philippines, without limiting any mandatory consumer-protection, privacy, or other legal rights that apply to you in your country or region and that cannot be waived by agreement.

Kratex is currently operated by an individual developer based in the Philippines. If the operator of Kratex changes, for example to a registered business, we will update these Terms and this section.

27. Dispute Resolution

Before initiating formal legal proceedings, you agree to contact Kratex and give us a reasonable opportunity to review and try to resolve the dispute.

Nothing in this section prevents you from exercising mandatory rights to file a complaint with a government regulator, privacy authority, consumer-protection authority, or court where such rights cannot legally be waived.

28. Apple App Store Terms

If you access Kratex through Apple’s App Store, including the Kratex app for Apple Watch, the following also applies:

• These Terms are between you and Kratex, not Apple. Kratex, not Apple, is responsible for the Service and its content.
• Apple has no obligation to provide maintenance or support for the Service. Kratex is responsible for support.
• If the Service fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for the Service.
• Kratex, not Apple, is responsible for addressing any claims relating to the Service or your use of it, including product-liability claims, claims that the Service fails to meet legal or regulatory requirements, and consumer-protection or privacy claims.
• If a third party claims that the Service infringes its intellectual property rights, Kratex, not Apple, is responsible for the investigation, defense, settlement, and discharge of that claim.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• You must comply with applicable third-party terms of agreement when using the Service (for example, your wireless data service agreement).
• Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept them Apple has the right to enforce them against you as a third-party beneficiary.

29. Entire Agreement

These Terms, our Privacy Policy, and any additional terms presented for specific features constitute the agreement between you and Kratex regarding the Service.

If any provision is found unenforceable, the remaining provisions remain effective to the extent permitted by applicable law.
